How to Submit a Notice
The fastest way to submit a notice is via our report form (choose "Copyright infringement (DMCA)"). You can also email the agent address above. Either method must include all of the elements below.
What a Valid Notice Must Contain
Under §512(c)(3)(A), a valid notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed (or, for multiple works on a single site, a representative list).
- Identification of the material that is claimed to be infringing and is to be removed, with information sufficient to locate it (a URL is best).
- Information sufficient to allow us to contact you — at minimum a mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner's behalf.
The /report form prompts for these elements explicitly.
Counter-Notification
If your content was removed and you believe the removal was a mistake or misidentification, you may submit a counter-notification under §512(g). It must include:
- Your physical or electronic signature.
- Identification of the removed material and its prior location (URL).
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, plus a statement consenting to the jurisdiction of the federal district court for your address (or, if outside the United States, for any judicial district where img.pro may be found) and that you will accept service of process from the original complainant.
Send counter-notifications to dmca@img.pro.
Repeat-Infringer Policy
Under §512(i), Moshi Inc. has adopted and enforces a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. Specifically, an account that receives three or more valid takedown notices within any rolling 12-month period will be terminated and its hosted media taken down.
Whether a notice is "valid" is determined by Moshi Inc. in its reasonable judgment, taking into account counter-notifications under §512(g) and any pattern of bad-faith reporting.
Misuse
Submitting a knowingly false DMCA notice may subject you to liability for damages under §512(f). Please be sure you own the work or are authorized to act on behalf of the owner before sending a notice.
